Tweaky Tools END USER LICENSE AGREEMENT (EULA)

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE OR SERVICE. BY INSTALLING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.

YOUR USE OF THE SOFTWARE AND SERVICE IS SUBJECT TO YOUR COMPLIANCE WITH THIS AGREEMENT.

ANY INFORMATION TWEAKY TOOLS COLLECTS ABOUT YOU OR YOUR DEVICE THROUGH THE SOFTWARE OR SERVICE IS GOVERNED BY THE TWEAKY TOOLS PRIVACY POLICY. BY USING THE SOFTWARE AND SERVICE, YOU CONSENT TO THIS COLLECTION AND PROCESSING AS DESCRIBED IN THE PRIVACY POLICY.

A. SOFTWARE LICENSE

1. LICENSE GRANT
   Upon acceptance of this Agreement and if no subscription is purchased, TWEAKY TOOLS grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Software on one computer for internal use. You cannot download Driver Updates without a subscription. All rights not expressly granted are reserved by TWEAKY TOOLS and its suppliers.
2. USAGE RESTRICTIONS
   You agree not to use the Software for commercial purposes or violate the restrictions in Section B.2 or the obligations in Section B.3.

B. SUBSCRIPTION SERVICE

1. LICENSE GRANT
   Upon acceptance of this Agreement and payment of the subscription fee, TWEAKY TOOLS grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software and Service on up to the number of computers specified in your subscription. Unauthorized use on additional computers may result in suspension of your account. TWEAKY TOOLS reserves the right to modify the Software, Service, or this Agreement at any time. Changes will be communicated via the Service or email, and continued use indicates acceptance of these changes.
2. USER OBLIGATIONS
   You agree to:
1. Not transfer, sublicense, sell, rent, or lease the Software or Service.
2. Not alter or remove any copyright or trademark notices.
3. Not copy the Software.
4. Protect the Software and Service from unauthorized use.
5. Not disassemble or reverse engineer the Software.
6. Not use false identities or impersonate others.
7. Respect TWEAKY TOOLS ' intellectual property rights.
8. Only use the Software and Service on personally owned computers for non-commercial purposes.
9. Keep your login details confidential.
10. Not create derivative works from the Software or Service.
11. Not disrupt the Service.
12. Not publish benchmarking analyses without consent.
13. Regularly back up important files.
14. Ensure compliance by authorized users.
15. Install updates as prompted.
16. Allow uninterrupted internet access for the Service.
17. Comply with all applicable laws.
3. OWNERSHIP AND INTELLECTUAL PROPERTY
   TWEAKY TOOLS owns all rights, titles, and interests in the Software and Service. You have no rights to sell, assign, or transfer the Software or Service. This Agreement does not convey any ownership interests to you. You agree to receive emails regarding TWEAKY TOOLS products and services.
4. THIRD-PARTY INTELLECTUAL PROPERTY
   Driver Updates are owned by their respective third-party suppliers. Use of these updates is subject to the supplier's license agreement. TWEAKY TOOLS is not responsible for any damage caused by downloaded Driver Updates.
5. LICENSE FEE AND REFUNDS
   You must pay the subscription fee to use the Service for downloading Driver Updates. Fees are in U.S. dollars. Refunds may be available under TWEAKY TOOLS ' refund policy.
6. UPDATES AND NEW FEATURES
   TWEAKY TOOLS may provide updates and new features at its discretion. Optional features or services may incur additional fees. All updates and optional features are part of the Service and governed by this Agreement.
7. INSTALLATION
   The Software is installed in the Windows Program Files folder under "DriverBoost." The installation process cannot be stopped once started, but all files will be removed during uninstallation.

C. AUTO-RENEWALS

1. Some packages include yearly recurring payments.
2. You will receive a reminder email 30 days before the next payment.
3. You can cancel by submitting a ticket or via live chat support.

D. GENERAL

1. Term
   This Agreement is effective upon acceptance and expires at the end of the subscription term or upon uninstallation of the Software. TWEAKY TOOLS may terminate this Agreement for any breach. Upon termination, you must uninstall the Software and stop using the Service. Provisions related to ownership, warranties, liability, and applicable sections will survive termination.
2. Warranty Disclaimer
   THE SERVICE AND SOFTWARE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. TWEAKY TOOLS MAKES NO WARRANTIES REGARDING DRIVER UPDATES.
3. Limitation of Liability
   TWEAKY TOOLS IS NOT LIABLE FOR ANY DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE SERVICE OR SOFTWARE, INCLUDING INDIRECT OR CONSEQUENTIAL DAMAGES. TWEAKY TOOLS' LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SERVICE.
4. Entire Agreement
   This Agreement constitutes the entire agreement between you and TWEAKY TOOLS and supersedes all prior agreements. Modifications must be in writing and signed by authorized representatives.
5. English Language
   This Agreement is originally written in English. Translations are for reference only. The English version controls.
6. Governing Law
   This Agreement is governed by California law. Any disputes must be brought in state or federal courts in Santa Clara County, California. You cannot assign this Agreement without consent. If any provision is unenforceable, the remainder will remain in effect. Actions must be brought within one year of occurrence.
7. Export Regulations
   The Software is subject to U.S. export laws and may be subject to regulations in other countries. You agree to comply with all such laws and regulations and indemnify TWEAKY TOOLS for any breaches.
8. Third Party Software
   Third-party software provided with the Software is licensed under its own terms and is not subject to this Agreement. Your rights to third-party software are governed by the applicable licenses.
9. Third Party Software Warranty Disclaimer
   THIRD-PARTY SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. YOU ASSUME ALL RISKS ASSOCIATED WITH THIRD-PARTY SOFTWARE.
   By installing and using TWEAKY TOOLS software and services, you acknowledge and agree to these terms and conditions.
